In its discussion of fraud perpetrated by certain gold mining operators, the government focuses on significant budgetary losses to the national economy, a situation that, according to the Cameroonian state, justifies regularising gold mining.

However, it is legitimate to agree with the Extractive Industries Transparency Initiative (EITI), from which Cameroon is suspended, that this implies a smuggling network, a lack of traceability, oversight, and transparency on the Cameroonian side. To achieve this, there would need to be a necessary level of effectiveness from every relevant government sector, which is currently questionable or nonexistent. Despite this initiative, one stakeholder remains strangely absent from this discourse:

The local communities who, during these same years of fraud, have suffered the daily consequences of gold mining, including soil degradation, water pollution, and the erosion of food security.

This blog is part of a process of reconstructing what this operation does or does not foresee for the affected populations.

[1]Perton Biyiha, “Cameroon: Gold smuggling deprives the public treasury of 577 billion FCFA in 5 years, ” Sika Finance, July 28, 2026,https://www.sikafinance.com/marches/cameroun-la-contrebande-d-or-prive-le-tresor-public-de-577-milliards-fcfa-en-cinq-ans_63257

1. A BUDGETARY-ORIENTED OPERATION, A SHORT-TERM REMEDY

The National Mining Company (Sonamines), the General Directorate of Taxes (DGI), and the General Directorate of Customs (DGD) of Cameroon joined forces for this initiative. Their mission was to audit nearly 200 mining companies suspected of operating illegally; to trace the flow of illegal exports, the vast majority (90%) of which were allegedly destined for the United Arab Emirates; [1]and finally, to recover the evaded revenue. To date, 200 companies deemed illegal have been closed and 53 mining permits revoked [2]a phenomenon attributed to the administrative freeze on the formalization of mining licenses, which, according to Cameroonian mining union leader Ousmanou Aladji Hamadou, « …fuels the illicit networks for marketing gold and diamonds. »[3]

This operation, which only presents a one-sided narrative of the state’s relationship with gold mining companies, fails to document the impact of these years of illegal exploitation on local communities. Thus, at the expense of the regions that have borne the brunt of mining activity, the money recovered from this operation will undoubtedly go to the public treasury for budgetary purposes; meanwhile, the environmental and social debt continues to mount.

2. WHAT RECOVERY DOES NOT FIX

In eastern Cameroon, the human and environmental cost of gold mining is already well documented. Between 2001 and 2024, 270,000 hectares of primary forest disappeared[4], partly due to gold mining, a devastating blow to this region, long considered the country’s « green lung. » A field report in Kambele [5](Jean Charles Biyo’o Ella; Notre-planet.info) describes former fertile farmland now covered in seemingly endless mining pits and polluted waterways that serve local communities. All this destruction further exacerbates food insecurity for these communities, the vast majority of whom depend on agriculture.

Furthermore, a limitation of the process, denounced by the National Union of Promoters of Diamond, Gold, and Artisanal Mining Offices in Cameroon, stems from the fact that in early August 2026, Sonamines suspended the issuance and renewal of certain licenses granted to purchasing offices,[6] leaving nearly 200 entities unable to formalise their operations and demonstrating a serious administrative dysfunction in the area of oversight of mining stakeholders. The paradox of this administrative freeze mechanically produces the very informality that the reform is supposed to combat, even though the reform has a legal basis.

3. A LEGAL FRAMEWORK THAT RECOGNIZES THE PRINCIPLE BUT NOT THE MEANS

The 2023 Mining Code does not entirely ignore the issue of community rights; indeed, it recognises, in principle, the right of local populations to a share of certain mining taxes (Articles 25(5) and 133(2)) and a right to direct compensation for populations affected by small-scale and industrial mining (Article 135). However, these provisions suffer from two specific flaws:

– The specific arrangements for the payment of this share are referred to implementing decrees which, to date, do not yet exist.

– Article 135 on direct compensation explicitly mentions only small-scale mining (small-scale mining operations using semi-industrial or industrial processes and whose annual production does not exceed a certain tonnage), industrial mines, and industrial quarries. It remains silent on semi-mechanised artisanal mining, the system under which almost all gold panning in the East operates.

In other words, the law exists on paper; the mechanism to make it effective on the ground does not. And it is precisely in this void that the current recovery operation is situated: it repairs the state budget, which also aims for 300 billion FCFA in additional mining revenue by 2026[7], but it does not fill any of the aforementioned legal gaps. And this is indeed one of Cameroon’s Achilles’ heels: the partial or nonexistent implementation of the laws.

This imbalance is not merely a matter of social justice; it threatens the very effectiveness and legitimacy of the operation. When questioned about the massive discrepancy between declared export figures and those recorded by importing countries, the Ministry of Mines and Sonamines themselves acknowledge lacking the financial and technological resources necessary to monitor production [8]. This makes control all the more complex, as production remains largely artisanal, informal, and therefore difficult to trace for export. An operation perceived by communities as purely extractive risks reinforcing existing distrust rather than reducing it, because while the state reaps profits, local populations receive nothing. This ultimately weakens the state’s ability to enforce its own controls and maintain close ties with its citizens.

4. WHAT A COHERENT RESPONSE WOULD REQUIRE

Curbing smuggling and ensuring the traceability of gold produced in Cameroon requires strengthened coordination between the Ministry of Mines, Sonamines, Customs, and tax authorities, with clearly defined roles. This is precisely what is recommended in Cameroon’s 2023 EITI reconciliation report. However, three main conditions could help transform this tax recovery into a broader, more inclusive, and community-based exercise in justice, without compromising its budgetary objective.

– Adopt without delay the implementing decrees provided for in Articles 25(5) and 133(2) of the Mining Code, and explicitly clarify that Article 135 also covers semi-mechanised artisanal mining to protect local operators.

– Publish a guaranteed minimum allocation of recovered funds to an environmental rehabilitation and community compensation fund in the affected areas. These funds would be managed by local authorities, who serve as the direct link between the population and the state. This would be done while ensuring regular audits to mitigate existing corruption risks.

– Involve communities, and in particular indigenous populations, in the monitoring system; not as mere beneficiaries informed after the fact, but as stakeholders in verifying damages and defining reparations. No one can better describe their needs than the community itself.

– Civil society organisations must redouble their efforts in advocating for and supporting local communities in this process of asserting their rights in the face of mining policies and a government that neglects their well-being. This support would allow them to better organise their demands and build a solid foundation for their arguments.

In summary, the tax and customs recovery operation launched by the government for August 2026, while belated and questionable, illustrates a tension that Cameroon has yet to resolve. This tension lies in the State’s ability to control the mining sector and assert its budgetary rights in the face of outright fraud. However, this process is progressing faster than its capacity to uphold the rights of the communities living there, who are literally in a situation of environmental, food, social, and moral insecurity. As long as this gap persists, every franc recovered by the treasury will serve as a reminder of what has not been rectified on the ground. Therefore, given this situation, we must call upon the Cameroonian State for fairer and more inclusive governance for communities, and appeal to the community’s awareness of this issue so that the fight for community rights led by RELUFA does not become ineffective.

[1] <a
